Legal Statement: Understanding of Insurance Exclusion for Household Goods, Personal Effects, and Property Damage

By submitting this form, you acknowledge and understand that insurance is not included for household goods, personal effects, or property damage.

Please note, our prices do not include insurance coverage. Any items transported or stored using Mr Shifter’s services are carried or stored at the Owner’s (Customer’s) risk, with no insurance, in accordance with the Contract and Commercial Law Act 2017.

This means:

  • All goods are stored or carried at the owner’s risk.
  • We (the carrier) will not pay compensation for goods that are lost or damaged unless we (the carrier) intentionally lose or damage them.
  • No cover is provided for any damage to property, including but not limited to walls, floors, and fixtures, during the moving or storage process.
Insurance Cover

We highly recommend you secure adequate insurance coverage for your goods and any potential property damage. You may click here to get a quote and arrange removal insurance.

Mr Shifter, and/or its agents, strongly advise that all customers ensure adequate insurance is in place for both private and commercial items during transit or storage, and to consider coverage for property damage.

While our team of professional movers takes the utmost care with your possessions and property, damages can sometimes occur. If you choose not to take out your own insurance, you acknowledge and accept that you are using our services “At Owner’s risk”, as outlined by the Contract and Commercial Law Act 2017, and that no compensation will be provided for damage to property.

Legal Statement: Payment and Default Terms

By engaging Mr Shifter’s services, all service users and customers agree to the following payment and default terms: READ MORE

  1. Payment Upon Job Completion
    Service users and customers must ensure that an acceptable form of payment is available upon completion of the job. Any delays caused while the truck waits for payment will be chargeable at Mr Shifter’s discretion. Mr Shifter, and/or its agents, accept the following payment methods:

    • Visa
    • MasterCard
    • Eftpos
    • WINZ payments
    • CashA 3% surcharge applies to all Visa and MasterCard transactions, which will be charged upon job completion. Payments via bank direct credit must clear before the job is deemed completed. Cheques are not accepted.
  2. Payment Terms
    The price for goods and services is due and payable in full upon completion of the job, or by the due date stated on the invoice provided.
  3. Overdue Payments
    If payment is not received by Mr Shifter, and/or its agents, by the due date, Mr Shifter reserves the right to charge interest at the rate of 10% per day on any overdue amounts. An administration fee of up to $150 + GST may also be charged for processing overdue payments, at Mr Shifter’s discretion.
  4. Legal Costs
    All costs incurred by Mr Shifter, and/or its agents, as a result of the service user’s failure to make payment by the due date, including legal costs and disbursements, shall be payable by the service user upon demand.
  5. Contract Termination
    Mr Shifter, and/or its agents, reserve the right to terminate the contract without prejudice to any other rights if the service user:

    • Defaults on any payments,
    • Commits an act of bankruptcy, or
    • In the case of a company, commits any act that renders it liable to be wound up or have a receiver appointed.

    In such cases, payment for all goods delivered and services rendered shall become immediately due and payable.

  6. Right to Repossess Goods
    Mr Shifter, and/or its agents, reserve the right to enter any premises where goods or services have been supplied to take possession of and remove those goods without liability for any damage caused during repossession. Mr Shifter may resell such goods and apply the proceeds towards the payment of the outstanding balance of the agreed purchase price.
