TERMS AND CONDITIONS

Please read the following information carefully. These terms and conditions are subject to change without notice.

This information is for residential, commercial, and business customers. Where price estimates are provided based on the information given by the customer, Mr Shifter, and/or its agents reserve the right to alter prices as a result of inaccurate information. This includes the dimensions, weight, number of items, or delivery access conditions. All Mr Shifter, and/or its agents’ customer service staff have been trained to request accurate information from the customer when quoting for any moving and delivery job. Additional charges may also be incurred for address redirection, additional labour required, storage, waiting time, services not requested, and packing materials.

Mr Shifter, and/or its agents will ascertain if any personal items or commercial goods are not safe to transport or are insufficiently packaged in a way that may cause potential damage to either the item being moved, other items, or the transport vehicle. We reserve the right to reject the acceptance of any item/s or goods. All Mr Shifter, and/or its agent’s professional movers follow strict Health and Safety regulations to ensure no unnecessary risks are taken with transporting any items or goods.

PAYMENT AND DEFAULT

Service users and customers must ensure they have an acceptable form of payment available upon completion of the job, as delays caused while the truck waits for payment are chargeable. Mr Shifter, and/or its agents, accept Visa, MasterCard, Eftpos, WINZ payments, and cash. All Visa and MasterCards are subject to a 3% surcharge, which will be charged when the job is completed. All bank direct credits must clear before the job is completed. Sorry, we do not accept cheques.

Payment Terms: The price of the goods and services shall be due and payable (in full) when the job is completed or on the due date stated on the invoice.

Overdue Payments: If payment is not received by Mr Shifter, and/or its agents on the due date, interest may be charged at Mr Shifter’s discretion at the rate of 10% per day on any overdue amounts. Additionally, an admin fee of up to $150 + GST may be charged for processing overdue payments, at the discretion of Mr Shifter and/or its agents.

Legal Costs: All costs incurred by Mr Shifter, and/or its agents as a result of the service user’s failure to pay by the due date, including legal costs and disbursements, shall be payable by the service user on demand.

Contract Termination: If the service user defaults on any payments, commits an act of bankruptcy, or in the case of a company, does any act rendering it liable to be wound up or have a receiver appointed, Mr Shifter and/or its agents may terminate the contract without prejudice to any other rights. In such cases, payment for all goods delivered and services rendered shall immediately become due and payable.

Mr Shifter reserves the right to enter any premises where goods or services have been supplied to take possession of and remove the same without being responsible for any damage caused. The company may resell such goods and apply the proceeds toward payment of the agreed purchase price.

ARRIVAL TIME

  1. Our designated arrival time is to be considered as a guide only. Various factors can affect our arrival time such as unexpected delays on the previous job(s), delays caused by traffic congestion and/or accidents, roadworks and/or closures, streets not on maps and/or incorrect directions supplied by customers, weather, truck breakdown, etc. Mr Shifter, and/or its agents will maintain contact with you in the event any delay is going to be significant.  

ESTIMATES AND PRICING

  1. Our estimate and quotes given for any particular job is provided based upon information supplied by the customer and/or their agent and can be affected by a number of things. The customer must ensure they have provided us with as much detail as possible to avoid delays which will cause the job to take longer than estimated. 
  2. The half-hourly rate is charged on a depot-to-depot system. Time will start when we leave the depot and the driver will estimate the drive back to the depot allowing for traffic.
  3. Typical delays that can be avoided and/or accounted for at the time of booking are; difficult  vehicle accessibility for loading, stairs, more items than advised at the time of booking, extra-large or odd-shaped items, distances from truck to house(s), waiting for customers and/or  keys, poor packing of cartons, additional pick up and/or drop off points, extreme weather  conditions,
  4. To help avoid unnecessary time accrued, wherever possible, the customer should advise Mr Shifter, and/or its agents ASAP of any road closures and/or events that could delay the transportation of your goods from the origination address to the destination.  
  5. Mr Shifter, and/or its agents reserve the right to modify and vary these terms and conditions at any time.
  6. If Mr Shifter, and/or its agents fail to enforce any terms or to exercise its rights under  these terms and conditions at any time, Mr Shifter, and/or its agents have not waived  those rights  

INSURANCE OPTIONS AND THE CONTRACT AND COMMERCIAL LAW ACT 2017

  1. Insurance is not included for Household Goods and Personal Effects.
  2. Please note our prices do not include insurance coverage. Our storage and transport delivery service are stored/carried at the Owner’s (Customer’s) risk with no insurance. As defined by The Contract and Commercial Law Act 2017. “All goods are stored/carried at the owner’s risk. This means that we (the carrier) will pay no compensation if the goods are lost or damaged unless we (the carrier) intentionally lose or damages them.”

INSURANCE COVER

  1. We suggest clicking here for removals insurance where you can get a quote and arrange coverage. Mr Shifter, and/or its agents recommend that all customers are to ensure there is adequate insurance coverage in place for private and commercial items and goods.
  2. Our team of professional movers endeavors to move your possessions carefully however on some occasions damages do occur.
  3. If you don’t wish to take out your own insurance, you are acknowledging and accepting that you are using our services “At Owner’s risk” as defined by The Contract and Commercial Law Act 2017. 

OTHER LIABILITIES & LIMITATIONS

  1. Whilst our team of movers provides the utmost care and attention to your house, office, and property whilst carrying out your move, there remains a risk of marking/ scuffs to door frames, internal walls, and stairwells, especially when handling larger furniture and whiteware items. Whilst the risk is low, all work carried out at either the loading or unloading site will be carried out at “Owners Risk” as defined in The Contract and Commercial Law Act 2017 refer to section 241.
  2. Particularly note that damage caused by vehicles to buildings, lawns, driveways, footpaths, underground pipes, cables, sewerage, and other underground installations is not covered. 
  3. Should our staff be instructed by the property occupier, move initiator, consignor, consignee or Shipper, or any person acting on their behalf to drive, park, or maneuver vehicles in or near an area where such damage is likely to occur, compliance with such instructions will not in any way involve the Company or its Insurers in responsibility for any subsequent damage which may be sustained. Such responsibility will rest solely in the hands of the Owner, Consignor, Consignee, Shipper, or initiator.
  4. All work is carried out on a “best-effort” basis. Whilst we try our best to make it on time for every booking and delivery, we sometimes do inevitably incur delays outside our control. Mr Shifter, and/or its agents are not liable for personal or business losses arising from such delays either directly or indirectly. 

CANCELLATION POLICY  

  • If you wish to cancel your booking you are advised to do so at the earliest possible opportunity to minimize any fees.  
  • If a cancellation is received within 24 hours of your booking, a minimum charge of 1.5 hours + GST for the team that you booked will be charged. This policy is in place to compensate the team for any lost time or potential bookings that could have been scheduled in the time slot that was reserved for your booking. It’s important to review and understand any cancellation policies before booking to avoid any unexpected charges.

LOCAL MOVES (Wellington & Auckland Districts) 

  1. The half-hourly rate is charged on a depot-to-depot system. Time will start when the truck leaves the depot and the driver will calculate the drive back to the depot allowing for traffic. Additional address pick-ups/drop-offs are charged at $35.00+gst per additional address.  

OUT-OF-CITY MOVES 

  1. The half-hourly rate is charged on a depot-to-depot system. Time will start when the truck leaves the depot and the driver will calculate the drive back to the depot allowing for traffic. 
  2. Additional address pick-ups/drop-offs are charged at $35.00+gst per additional address. 
  3. There is an additional charge of $1.50 +gst per km for total distance return. 

PIANO MOVES (Wellington & Auckland Districts) 

  1. There is a minimum charge of 1.5hrs including travel, any additional time spent is charged at a per half hour per team member charged on a depot-to-depot system.  Time will start when your truck leaves the depot and the driver will calculate the drive back to the depot allowing for traffic. 
  2. Additional address pick-ups/drop-offs are charged at $35.00+gst per additional address.
